General Terms and Conditions
MEISER rental + event GmbH, hereinafter referred to as ‘MEISER’.
1. The following rules apply to all events organised by the contractual partner MEISER rental + event GmbH (MEISER), Im großen Boden 4, 56589 Niederbreitbach, Germany, in particular for track days in which participants take part with their own vehicles, as well as for the rental of vehicles from MEISER rental + event GmbH within the scope of MEISER events, and for so-called tourist or taxi rides and the arrangement of track day events or taxi rides by third parties. A tourist ride is the public use of the Nürburgring Nordschleife and Grand Prix circuit advertised by Nürburgring 1927 GmbH & Co. KG for a fee determined per lap or time quota. The terms of use of Nürburgring 1927 GmbH & Co. KG, which can be viewed at https://nuerburgring.de/info/company/gtc/driving-regulations, apply.
2. For tourist rides, the StVZO (German Road Traffic Licensing Regulations) and StVO (German Road Traffic Regulations) apply in particular, especially § 3 (1) StVO and § 29 (1) StVO. Tourist drives are expressly not intended for the purpose of achieving maximum speeds or determining the shortest driving time.
3. Road-legal and non-road-legal vehicles can be rented from MEISER for track day events. These events are expressly not intended for the purpose of achieving maximum speeds or determining the shortest driving time.
4. Road safety events organised by MEISER allow participants to hire road-legal vehicles. These events are expressly not intended for the purpose of achieving maximum speeds or determining the shortest travel time.
5. Road events, i.e. guided road tours, are intended to showcase the landscape. These events are expressly not intended for the purpose of achieving maximum speeds or determining the shortest travel time. The StVZO (German Road Traffic Licensing Regulations) and StVO (German Road Traffic Regulations) must be observed on public district, state and federal roads.
6. Racing taxi events within the framework of the NLS may be carried out by MEISER in racing cars. The participant is exclusively a passenger in this case. These events are expressly not intended for the purpose of achieving maximum speeds or determining the shortest driving time.
7. Only persons who have a valid European driving licence for the car used at the event are permitted to participate. Participants undertake to behave considerately towards other participants at all times. Participants with their own vehicle that is not provided by MEISER must provide proof of at least statutory liability insurance. Such a car must also comply with the German Road Traffic Regulations (StVO).
8. At track day events, participants are required to wear a seat belt and a helmet suitable for motor sports. Participants shall not intentionally or through gross negligence endanger themselves, others or the vehicles used. Instructions from the organiser, its representatives or vicarious agents, as well as the track management, must be followed without restriction. Warning signals and flags must be observed at all times and participants must behave accordingly. MEISER or the respective organiser reserves the right to exclude a participant from the event in the event of a violation. In such a case, there will be no refund of the fees paid for participation, reimbursement of expenses or other costs.

11. The participant acknowledges the rules of use for the toll, race or training track used during the event in their currently valid form and will comply with them.
12. All costs incurred by the participant in connection with their participation in the event, for example due to damage to the track (e.g. crash barriers, cleaning fees, towing costs, tyre stacks, etc.), shall be borne by the participant. The costs shall be paid directly and immediately to the operator of the toll, race or training track. The participant undertakes to
to reimburse MEISER directly for the costs upon presentation of proof, should MEISER have to advance the costs incurred. If a track day or driver safety event is booked by a third-party organiser and MEISER merely registers the participant for this event, the respective terms and conditions and specifications of the third-party organiser shall apply, of which the participant shall be notified separately prior to conclusion of the contract.
13. The participant warrants that he/she does not suffer from any medical or psychological illnesses or impairments and is not undergoing any addiction treatment that could impair his/her participation.
14. All events take place regardless of weather conditions. MEISER reserves the right to change the event or cancel it in the event of force majeure or exceptional circumstances, as instructed or determined by the track management and/or the operator of the toll, racing or training track, as well as an official order from authorities or other public institutions. This does not give rise to any claim for damages or costs against MEISER. For the purposes of this entire contract, force majeure shall be understood to mean all circumstances that cause a failure or delay in the fulfilment of the obligations of the party, directly or indirectly, due to forces beyond its control.
a) The participant acknowledges and will comply with the rules of use of the toll, race or training track used during the event in their currently valid form.
b) All costs incurred by the participant, for example due to damage to the track (e.g. crash barriers, cleaning fees, towing costs, tyre stacks, etc.) in connection with participation in the event, shall be borne by the participant. The costs shall be paid directly and immediately to the operator of the toll, race or training track. The participant undertakes to reimburse MEISER immediately upon presentation of evidence if MEISER advances the costs incurred. If a track day or driver safety event is booked by a third-party organiser and MEISER merely registers the participant for this event, the respective terms and conditions and specifications of the third-party organiser shall apply, of which the participant shall be notified separately prior to conclusion of the contract.
a) If closure occurs during an event that has already begun, MEISER will transfer the remaining laps or unused kilometres to another event or issue a voucher valid for the next 24 months.
b) If the booked event has to be cancelled or the participant is unable to attend due to force majeure, the party who first becomes aware of this must inform the other party immediately. MEISER will issue a voucher for the full value of the booking, which is valid for the next 24 months and can be used by the participant at any event organised by MEISER as soon as the hindering circumstance ceases. The same applies to the closure of the track or changes to opening hours.
15. In the event of cancellation of the booked event or the booked vehicle as well as other services, a refund will be made as follows:
a) For cancellations within 14 days prior to the agreed date, the price will not be refunded.
b) For cancellations between 14 and 30 days before the agreed date, 50% of the price will be refunded. (Track day admission fees and third-party fees are not affected).
c) For cancellations 30 days or more before the agreed date, 75% of the price will be refunded (track day admission fees and third-party fees are not affected).
16. To conclude a contract for an event or to rent a vehicle, a copy of these General Terms and Conditions must be submitted to MEISER.
17. If a dashcam is installed in the rented vehicles, participants and accompanying persons agree by signing that the journeys will be recorded for their safety and for the safety of MEISER. This consent includes photo, sound and film recordings made during the event or the rental period. Technical failure of such equipment does not entitle the participant to a refund. MEISER is entitled to use these recordings free of charge for advertising purposes.
18. The parties agree to submit any disputes arising from or in connection with this contract to the jurisdiction of the Local Court of Koblenz or to another court where the customer has their place of residence or property.
For renting a vehicle
1. MEISER offers its own vehicles and those of third parties for hire at events (track days, driver safety events, road tours and tourist trips), which can be used during the events.
2. The vehicles are checked by MEISER and are handed over to the hirer with a full tank of fuel, in a roadworthy and safe condition, and cleaned. At the end of the rental period, the vehicle must be returned to MEISER immediately. MEISER will inspect the vehicle after it has been returned. If the vehicle is not returned with a full tank (98 octane petrol (Super Plus)), MEISER will charge the renter €3 per litre of fuel separately. This only applies to vehicles rented as part of the Basic Package. In the event of heavy soiling, the renter shall pay the cleaning costs charged by MEISER. MEISER accepts no liability for items left in the vehicles.
3. If the renter does not book the vehicle for the entire day, it must be returned as follows:
a) When booking a 40 km (2 laps) package, the vehicle must be returned 2 hours after handover by MEISER, or in the case of a morning booking, by 12:45 p.m. at the latest, and in the case of an afternoon booking, by 8:00 p.m. at the latest.
b) If an 80 km (4 laps) package is booked, the vehicle must be returned 3 hours after handover by MEISER, or in the case of a morning booking, by 12:45 p.m. at the latest, and in the case of an afternoon booking, by 8:00 p.m. at the latest.
c) When booking a 120 km (6 laps) package, the return must take place 4 hours after handover by MEISER, or in the case of a morning booking, by 12:45 p.m. at the latest, and in the case of an afternoon booking, by 8:00 p.m. at the latest.
d) When booking a 160 km (8 laps) package, the vehicle must be returned 5 hours after handover by MEISER, but no later than 8:00 p.m.
e) Unless otherwise expressly agreed in writing, vehicles booked for the afternoon or rented for the day must always be returned to MEISER by 8 p.m. at the latest. For all bookings, a separate fee of 15% of the booked services will be charged by MEISER for returns that are more than 15 minutes late.
4. The vehicles are intended for use on the Nürburgring Nordschleife, Nürburgring Grand Prix circuit, driving safety centre, Spa-Francorchamps and other race tracks and public sections. The vehicles must be used properly and with foresight. The costs for petrol and track fees are to be paid by the hirer when booking the Basic Package. The hirer shall comply with all legal provisions relating to the hire and, in particular, the provisions of the Road Traffic Regulations (StVO). Fines, penalties or similar charges relating to the use of the vehicle are to be paid by the hirer.
5. The rented vehicle may not be transferred to third parties. The renter and authorised driver(s) are only the person(s) named in the contract. MEISER reserves the right, at its own discretion (e.g. in the event of adverse weather conditions, driver skills, vehicle availability, etc.), to offer the renter an alternative vehicle; The renter must be informed immediately of any vehicle change. Any positive difference between the price of the vehicle booked and the price of the vehicle actually used will be refunded to the renter or, at the renter's discretion, converted into a voucher valid for 12 months. A vehicle change by MEISER entitles the renter to terminate the contract. MEISER shall not reimburse any costs incurred by the renter up to this point.
6. During the journey, the renter must check the vehicle's displays, in particular tyre pressure, engine, oil and water temperature. As soon as the renter notices a defect while using the vehicle, this must be reported to MEISER immediately. Any suspicion of a malfunction must also be reported to MEISER immediately. Continuing to drive the vehicle may cause considerable damage. Over-revving the engine (in BMW e36 325i and BMW e90 325i from 6,900 rpm, Suzuki Swift 7,200 rpm, Hyundai i30n 7,200 rpm) due to improper gear shifting or similar requires the technical condition of the engine to be checked; the renter undertakes to pay the costs incurred as a result. For inspection purposes, the data recording system will be read out after the vehicle has been returned to MEISER
7. The vehicle must be used properly. In cases of improper use (such as drifting, burnouts, etc.), MEISER reserves the right to issue a warning to the renter or to prohibit further use. In such cases, no refund will be made for the booked use of the vehicle. The hirer shall be liable for damages and above-average wear and tear to the vehicle, in particular to tyres and brakes.
If the vehicle is equipped with launch control, the hirer and driver are prohibited from using it.
8. When mileage packages are agreed, no credit will be given for unused kilometres within the specified time frame. The only exception to this is if there was no opportunity to use the booked service due to the early closure of the race track/event due to third-party fault or force majeure. In this case, the unused kilometres will be credited in the form of a voucher.
9. The hirer is responsible for damage to the hired vehicle, the track (e.g. crash barriers/barriers), other affected vehicles or persons, and for any towing and rescue costs, even if an instructor/coach is present in the passenger seat. This includes extreme situations in which the instructor/coach has to actively intervene in driving manoeuvres and also cases in which the instructor/coach is driving the rented vehicle.
Cost coverage when using a hire car
1. The hirer undertakes to be liable for all internal/external damage, theft or mechanical defects (e.g. clutch) up to the maximum amounts listed below that occur during the hire period of the vehicle. This applies regardless of which car was reserved. The same applies to all repair costs or cost estimates/expert opinions from third parties. The renter accepts liability for MEISER vehicles to the following extent:

BMW e90 325i: £15,500
BMW g20 330i: £65,000
Hyundai I30N Performance: £22,500
VW Golf GTI Performance: £22,500
The hirer's obligation to compensate for damage exists independently of the above and is limited to a maximum of
of the amount of the actual damage or to the extent of the usual depreciation in value. The hirer expressly has the right to prove that the damage did not occur as a result of negligent behaviour or improper use. The hirer also has the right to prove that the depreciation in value was significantly lower. In the case of wilfully caused damage, the tenant is liable for 100% of the damage, irrespective of the above. Payment of compensation does not entitle the tenant/driver to acquire ownership of the vehicle or individual vehicle parts.
In the event of third-party damage, the renter undertakes to assume 100% liability for third-party claims on public roads and race tracks (including tourist drives). In the event of damage caused intentionally, the renter shall also be liable for 100% of the damage, irrespective of the above.
For participation in co-pilot rides in race taxis as part of racing teams
1. MEISER offers rides in vehicles (so-called race taxi rides) at events. These are also arranged for external racing teams.
2. The events are not intended for the purpose of achieving maximum speeds.
3. The organiser provides vehicles that are suitable for use on race tracks and are in perfect technical condition. Only qualified and experienced drivers will carry out the booked rides.
4. The participant is familiar with the general conditions of participation as well as the conditions of the organiser and the operator of the race track and undertakes to comply with all rules of conduct.
5. The course of the co-pilot rides is at the sole discretion of the driver of the car. The participant has no claim to a specific driving style. It is
Participants are strictly prohibited from interfering with the mechanical processes involved in driving. Participants must strictly adhere to all instructions given by the organiser and the respective driver. 6. The organiser and its vicarious agents and authorised representatives shall not be liable for personal injury or property damage incurred by the participant as a result of participating in the event, except in cases of intent and gross negligence.
7. The participant warrants that they do not suffer from heart or spinal problems. They also warrant that they do not have any other ailments or illnesses that could impair their participation.
8. The organiser reserves the right to have the service owed by him performed by a third party. In doing so, the organiser undertakes to select the third party carefully so that the participant receives a service of the same type and quality. In such cases, the organiser assumes no liability for the service to be provided, but only for the careful selection of the third party.
Disclaimer
1. Participation in the event is at the participant's own risk. The participant bears sole civil and criminal liability for all damage caused by him, including damage to the vehicle he is using. By signing this declaration, the participant waives all claims against MEISER, its representatives and vicarious agents, as well as the operator of the toll, racing and training tracks and its agents and assistants, for all personal injury, property damage and financial loss, with the exception of damage caused by intent or gross negligence.
2. Should third parties assert claims against MEISER, its representatives and vicarious agents, as well as the operator of the race track and its agents and assistants in connection with the participant's participation in the event, the participant expressly declares that they shall be indemnified from liability.

4. There are no verbal side agreements. Further agreements must be made in writing to be valid.
